Car Sharing App - Terms of Use

1. Introduction

The terms and conditions below apply to your use of the Volkswagen Community Car Sharing App and Car Sharing Services (collectively referred to as “the Services”) provided by Volkswagen Mobility Solutions Rwanda Limited (“Volkswagen”).


By using the Services you:

● Agree to these terms and conditions.

● Warrant that you have the legal capacity and are authorised to make use of the Services.


If you do not agree to these terms and conditions, please discontinue your access to the Services.

2. Territory

The Services are for use within the Republic of Rwanda only.

3. Volkswagen Responsibilities

Volkswagen is responsible for:

● Servicing and maintenance of the vehicles.

● Insuring the vehicles.

● Towing in the event of a breakdown or accident.

4. Your Responsibilities

You are responsible for:

● Registering on the App. An Android smartphone or computer compatible with the App is required.

● Ensuring that you have a valid driver’s licence before driving a vehicle.

● Collecting the vehicle and keys from the designated area.

● Adhering to the laws relating to access to the Services, including but not limited to road traffic legislation.

● Parking fees.

● Refuelling

● Returning the vehicle and keys to the designated area.

● Providing a rating and comment on the App relating to the Services after completion of each trip.

● Notifying Volkswagen of any loss of or damage to the vehicles within an hour of the incident. The number to call is provided on the App.

● Payment of all traffic fines arising from use of the vehicles.

● In the event of an accident, ensuring that:

1. The vehicle is secured and removed from the accident scene only by parties approved by Volkswagen.

2. All requirements imposed by legislation or other responsible authorities are complied with.

3. All information and/or other assistance which Volkswagen may require regarding submission of an insurance of a claim or pursuing a recovery in respect of loss of or damage to the vehicle is provided.

5. Vehicle Booking

You are responsible for:

● Booking of a vehicle shall be conducted through the App.

● Upon confirmation of a booking, billing begins after the earlier of 15 minutes or the vehicle starting.

● A booking may be cancelled at any time before the earlier of 15 minutes from confirmation of the booking or starting of the vehicle.

● To confirm completion of a trip and stop the billing, you must:

1. Return the vehicle and key to the designated areas.

2. Confirm on the App that the trip is complete.

● Billing will also stop upon you reporting that the vehicle has broken down or that you have stopped driving as a result of being involved in an accident.

6. Vehicles

If a vehicle requires repair or replacement for any reason, Volkswagen may, in its discretion, attend to the repair or replacement of the vehicle, but shall be under no obligation to do so.

7. Security

You must keep your access details (including user name and password) confidential. Use of your access details shall be regarded as being by you.


You are permitted to use only one account. We may decline access to the Services if we are unable to verify any information provided to us.

8. Transfer and ownership of data; message reception and user insights

To enable the necessary information transmission through the App, an internet connection is required. You are responsible for any data transmission charges.


To use the App’s navigation feature, your mobile telephone must be able to transmit a location recognised by the applicable telecommunication network service provider. It is also necessary that the functionality be enabled your device.


The App provides for tracking of the vehicle’s location. The vehicle is also equipped with a tracking device. Volkswagen will therefore be able to track the movement of the vehicle.


The App includes the functionality of the user receiving information using push notifications and SMS. Any costs associated with the reception of these messages are your responsibility.


The App uses Google Analytics and Firebase Analytics as its analysis service. The data generated remains the property of Volkswagen.

9. Payment

The online dashboard provided to the party responsible for the account will reflect the amount payable in respect of the Service provided.

10. Changes

In order to maintain and constantly improve the Services, Volkswagen may make changes. Volkswagen therefore reserves the right to change the App, replace, increase or reduce the number of vehicles, or amend these terms and conditions without prior notice. Your continued use of the Services shall be confirmation of acceptance of the changes.


In some instances, Volkswagen may provide notification of updates.


The updated version of the App, including terms and conditions will apply immediately upon being updated.


If at any stage you do not wish to adhere to the updated version of the Services, please:
10.4.1 Return the vehicle and keys. 10.4.2 Notify Volkswagen. 10.4.3 Uninstall the App.


Volkswagen shall be entitled to suspend or terminate the Services without notice, but will endeavour to provide you with prior notice.

11. Intellectual Property Rights

All intellectual property rights arising from the Services shall vest in Volkswagen and/or other Volkswagen Group Companies.


No provision of the Services is a licence or other form of permission to use any of the abovementioned intellectual property for any purpose other than that provided for in this agreement.


Volkswagen shall be entitled to use any input or feedback you provide. Volkswagen shall not be under any obligation to provide compensation for such material.

12. Warranty, Liability and Indemnity

Volkswagen endeavours to provide the Services free of interruptions, errors or breakdowns, but cannot guarantee error-free or uninterrupted availability. Volkswagen shall therefore not be liable for any loss, damage, costs or any other claims arising from the use of the Services. The only recourse shall be discontinuation of access to the Services.


Volkswagen shall not be responsible for any property left in any of the vehicles.


Volkswagen may hold you liable (in its sole discretion) for any loss or damage arising from recklessness, gross negligence or contravention of legislation.

13. Personal Information

We receive and store information you enter on the App or which you provide when contacting us. The types of personal information collected include but are not limited to your name, email address, phone number, identity document number, company name and registration number.


The personal information you provide is used to enable you to set up a user account and profile, to enable us to administer the app, to enable correct billing, to assist us in improving the content of the app and to communicate with you. It is therefore important that the information on your profile is correct and up-to-date. You can update your details by contacting us using the “Contact Us” tab or the contact details provided at the end of these terms. We may request supporting documentation to verify the updated information you provide us before implementing the update.


We will not use your personal information for any purpose other than for the purposes you have authorised based on these terms, as amended from time to time.


We may disclose your personal information if legally obliged to do so.


We are constantly endeavouring to improve the quality of the Services. To assist us in this regard, we may track various activities on the app including but not limited to profile updates, bookings, roadside assistance requests and vehicle locations.


If you uninstall the App, residual copies of your profile information may temporarily remain on backup media.

14. Misuse

By using the Services, you undertake not to (directly or indirectly)

● Misuse the Services.

● Access or use the Services for any purpose other than that for which they are made available.

● Use any device or software which interferes with the Services.

● Use the App as part of any website or the Services for commercial purposes.

● Use the Services in a way intended to harm, or which could result in harm to you or to other persons.

● Gather information about others without their prior written consent.

● Bypass any measures we may use to prevent or restrict access to the Services.

● Harvest any content from the app.

● Make any attempt to modify the Services.


Volkswagen reserves the right to terminate your access to the Services if you misuse them, without prejudice to any other rights Volkswagen may have.

15. Jurisdiction

This agreement will be governed by the Laws of Rwanda.

16. Dispute Resolution and Arbitration

Disputes which cannot be resolved between us shall be decided by arbitration. The proceedings shall be referred to a panel of three (3) arbitrators, where each party shall appoint its own arbitrator, and the two shall meet to appoint a third arbitrator who shall also become the Chair of the Panel.


The arbitrators shall determine the procedure to be adopted for the hearing of the dispute.


The arbitration shall be held in Kigali, Rwanda, but may be conducted by video conference at either party’s request.


The dispute shall be decided informally and the decision of the arbitrator shall be final and binding.

Move Ride App - Terms of Use

1. Introduction

1.1 The terms and conditions below apply to use of the App and Ride Hailing services (collectively referred to as “the Services”) provided by Volkswagen Mobility Solutions Rwanda Limited (“VWMSR”).


1.2 By using the Services you:

● Agree to these terms and conditions.

● Warrant that you have the legal capacity and are authorised to make use of the Services.

● Warrant that all personal details are accurate, complete and current.

● Warrant that where making payment other than in cash, you have the authority to use the payment facility which you select.


1.3 If you do not agree to these terms and conditions, please discontinue your access to the Services.

2. Territory

The Services are available within the Republic of Rwanda only.

3. The Services

3.1 In addition to these terms and conditions, the Services are also subject to the terms and conditions of third party service providers including, but not limited, to those relating to payment platforms.

3.2 To enable the vehicle you have ordered to locate you, it is necessary to provide the required collection and delivery points. The location setting must therefore be activated.

3.3 Once you have confirmed your order, you have a grace period of five minutes within which to cancel should you no longer require the ride.

3.4 A cancellation fee will apply if you:

● Cancel after the five minute grace period.

● Are not at the collection location when the vehicle arrives.

4. User credentials

You are responsible for:

4.1 Maintaining the confidentiality of your username and password.

4.2 Notifying us immediately if you suspect or become aware of any unauthorised use of your account or access of your password.

5. Fees

In using the Services, you acknowledge that:

5.1 You are responsible for the fees for the Services and data charges of the internet service provider.

5.2 Payment will be through the payment you choose.

6. Termination

We may terminate your account for reasons including, but not limited, to the following:

6.1 Breach of these terms and conditions.

6.2 Use of the Services for any purpose other than that for which they are provided.

7. Intellectual Property Rights

7.1 The Services and all intellectual property rights relating to the Services shall remain the sole property of VWMSR and/or other Volkswagen Group Companies.

7.2 Use of the Services does not entitle you or any other party to VWMSR intellectual property

7.3 VWMSR shall be entitled to use any input or feedback you provide without any obligation to provide compensation.

8. Changes

8.1 In order to maintain and constantly improve the Services, VWMSR may make changes. VWMSR therefore reserves the right to change the Services, or amend these terms and conditions without prior notice. Your continued use of the Services shall be confirmation of acceptance of the changes..

8.2 In some instances, VWMSR may provide notification of updates.

8.3 The updated version of the App, including terms and conditions will apply immediately upon being updated..

8.4 If at any stage you do not wish to adhere to the updated version of the Services, please:

● Refrain from using the Services.

● Uninstall the App.

8.5 VWMSR shall be entitled to suspend or terminate the Services without notice, but will endeavour to provide you with prior notice.

9.2 VWMSR shall not be responsible for any property left in any of the vehicles s.
